RULES OF THE “Match with your Matcha” COMPETITION

Article 1: Purpose

DK FRANCE, located at 106 Avenue Marx Dormoy – 92120 MONTROUGE, hereinafter referred to as the “Organising Company”, is organising a free competition with no obligation to purchase, entitled “Match with your Matcha ” (hereinafter the “Competition”) in accordance with the terms and conditions set out in these rules (hereinafter the “Rules”).

Participation in the Contest implies full and unconditional acceptance of these Rules, in their entirety, and their application by the Organising Company.

The Contest and its promotion are not managed or sponsored by Instagram. In this context, the Organising Company releases Instagram from any liability regarding all matters relating to the Contest, its organisation and its promotion.

Article 2: Conditions of entry

Entry to the Competition is open to any natural person of legal age residing in mainland France (excluding overseas departments and territories) (hereinafter the “Entrant” or “Entrants”).

The following are excluded from participation: employees of the Organising Companies, any service providers who have collaborated in the organisation of the Competition, and their families (including those in the same tax household).

Article 3: Principles and terms of participation

This Competition takes place exclusively on the official Instagram page @dunkinfrance from 19 March to 10 June 2026 inclusive.

Only entries made during this period will be considered.

To enter, the Participant must:

- Follow the Instagram page @dunkinfrance;

- Send a full-length photo of the Participant, dressed in the colours of their favourite matcha, with their favourite DUNKIN’ matcha, via private message (DM) on the Organising Company’s Instagram account @dunkinfrance.

The terms and conditions governing the processing of the Participant’s personal data are set out in Article 8 of these Rules.

To ensure compliance with these Rules, the Organising Company reserves the right to verify the identity of Participants, their age and their place of residence within the limits of its powers as the organiser of a competition. Any entry containing falsified, inaccurate or incomplete details will not be considered.

Pursuant to the Criminal Code (Articles 323-1, 323-2, 323-3 and 323-3-1), any Participant who has developed or used software to play the Game automatically shall be excluded, and a complaint may be filed by the Organising Company for attempted fraud.

For the avoidance of doubt, it is specified that the Participant must refrain, in their photo – which may be accompanied by a comment – from any representation and/or statement, including but not limited to:

  • of a vulgar, pornographic, racist, paedophilic nature or harmful to minors;
  • of a defamatory, abusive or slanderous nature towards third parties, whether natural or legal persons;
  • infringing on the privacy or image rights of third parties and/or in breach of applicable laws;
  • contrary to public decency and/or public order;
  • reproducing an element subject to intellectual or industrial property rights, such as, but not limited to, an original work, a trademark, a registered design, a patent, etc.

Article 4: Selection of the Winner

The Winner will be selected as follows: the communications agency MARCEL1 will select the best photo submitted by a Participant in the DUNKIN’ Competition at the discretion of the communications agency MARCEL, based on its own criteria (defined in consultation between the Organising Company and the MARCEL agency).

The Winner will then be contacted by the MARCEL agency via the Instagram account @dunkinfrance, by private message sent to the Instagram account used to validate their entry, no later than 4 (four) days from 11 June 2026.

If the Winner does not respond within 4 (four) days of the date on which the private message was sent, the Winner forfeits the Prize and the Organising Company may, at its discretion, decide to retain it or award it to another Participant. No notification will be sent to unsuccessful entrants.

Participants who have not received notification via private message are considered to have lost the Competition.

Article 5: Prizes on offer

The Competition offers the following prizes, awarded to a single Winner in accordance with the terms set out in Article 4 of these Rules.

Prizes:

52 (fifty-two) vouchers for the purchase of size M matcha drinks without extras (Hot or Cold) with a unit value of between €5.65 incl. VAT and €5.85 incl. VAT, issued up to a limit of one per week, to be used in the Île-de-France region and under the conditions set out in Article 6 of these Rules (hereinafter the “Prizes”).

Photographs or other illustrations used in any promotional material for the Competition have no contractual value with regard to the characteristics of the prize ultimately awarded.

All of the Prizes mentioned above are accepted as set out below. Under no circumstances may the Winner claim a change to their Prizes. No alternative or financial equivalent of the Prizes may be requested by the Winner. Each Prize is non-transferable and may under no circumstances be awarded by the Organising Company to another person.

The Prizes are non-transferable, non-modifiable and non-refundable for their monetary value. The value indicated for the Prizes corresponds to the average retail price including VAT currently charged or estimated at the date of drafting of these Rules. It is provided for information purposes only and is subject to change. The Winner acknowledges and accepts that the Organising Company cannot be held liable in this regard.

In the event of the unavailability of one or more of the Prizes, force majeure and/or events beyond its control, the Organising Company reserves the right to replace the the Prize(s) concerned with any other prize of equivalent value, as determined by the Organising Company, without the Organising Company being held liable, nor may the Winner make any claim in this regard, nor may the Winner claim any compensation or financial equivalent.

The Organising Company reserves the right not to award any Prizes to the Winner if it is found that the Winner has committed fraud or has not complied with the terms of these Rules.

Article 6: Notification of the Winner and Award of Prizes

The Winner will be notified by the MARCEL agency via the Organising Company’s Instagram account: @dunkinfrance. The MARCEL agency will contact the Winner via a private message on the Instagram account used to validate their entry, no later than 4 (four) days from 11 June 2026.

To claim the Prizes, the Winner must create a loyalty account and download the DUNKIN’ app.

Should the Winner refuse to create a loyalty account, the Organising Company reserves the right to make a new selection and award the Prizes to another Winner.

From 1st July 2026, every week for a period of 52 (fifty-two) weeks, a voucher (hereinafter the “Voucher”) entitling the holder to a medium-sized hot or cold matcha with no extras will be available in the “Good Deal” section of the Winner’s official DUNKIN’ account.

This Voucher is valid for seven (7) days from the date it becomes available on the Winner’s DUNKIN’ mobile app. If the Voucher has not been used after seven (7) days, it will expire and become unusable.

To claim the Prizes, the Winner must visit (each week) one of the following DUNKIN’ stores of their choice:

Prizes may only be collected by the Winner at one of these stores, limited to one medium-sized hot or cold matcha per week, excluding any extras.

The Organising Company reserves the right to subcontract the collection and/or delivery of Prizes to any person of its choice.

The Winner is responsible for the accuracy of the information they have provided. Consequently, they are responsible for the accuracy of the email address provided to ensure their Prizes are delivered to them.

The Organising Company cannot be held liable for the failure to receive emails sent by the Organising Company, should the Participant have provided an incorrect email address.

Article 7: Liability of the Organising Company

The Organising Company reminds Participants of the characteristics and limitations of the internet and accepts no liability in the event of internet malfunctions preventing access to the Competition or its proper conduct.

Furthermore, the Organising Company accepts no liability in the event of data hacking or infection by any viruses circulating on the network. It is the responsibility of each participant to take all appropriate measures to protect their own data, hardware and software against any infringement.

Moreover, the Organising Company is not liable in the event of:

  • Hardware or software malfunction,
  • Human error or electrical faults,
  • Any delays, losses, thefts or damage to postal or electronic mail. Complaints must be made by the recipients directly to the companies responsible for delivering such mail,
  • Disruptions that could affect the smooth running of the Competition.

In any event, if the administrative and/or technical running of the Competition is disrupted by a cause beyond the Organising Company’s control, the Organising Company reserves the right to suspend the Competition.

Article 8: Participants’ personal data

The data controller is the Organising Company, which records this in its register of processing activities.

In connection with the Competition, the Organising Company may collect the following data:

  • Participants’ Instagram username,
  • Title,
  • Surname,
  • First name,
  • Email address,
  • Photograph of the Participants,
  • Account number for the DUNKIN’ France app.

The processing of personal data carried out in connection with the Competition is intended for the purposes of managing the Competition, determining the Winner, and awarding and delivering the Prizes.

The processing of personal data collected in connection with the management of the Competition is based on the implementation of these Rules. The processing of personal data collected in connection with the management of the Contest Winner is based on the Winner’s consent. Personal data is intended for the Organising Company.

The personal data collected may be disclosed to service providers and subcontractors for the performance of services carried out on behalf of the Organising Company in connection with this Contest.

They are also required to record this processing in their register of processing activities.

The Organising Company may also disclose Participants’ personal information in the event of receiving a request from a judicial authority or any administrative authority empowered by law seeking the disclosure of such information in accordance with the legislative provisions in force.

The Organising Company implements appropriate measures to safeguard the security and confidentiality of Participants’ personal data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorised third parties.

Participants’ personal data is retained for the period necessary to fulfil the purpose of the processing. This period shall not exceed two (2) months from the end of the Competition. With regard to the retention period for the administration of the Winner, this is one (1) year from the date of the Winner’s designation. The data is stored in accordance with current legislation on the protection of personal data.

In accordance with the French Data Protection Act No. 78-17, as amended by the Order of 12 December 2018 and the Decree of 29 May 2019, and with European Regulation No. 2016/679/EU of 27 April 2016, Participants have the right to access, data portability, objection, rectification and erasure of personal data concerning them by:

Participants may obtain a copy of the data concerning them in an accessible format.

In the event of a complaint, the Participant has the right to refer the matter to the Commission Nationale de l’Informatique et des Libertés at the following address: 3 Place de Fontenoy, 75007 PARIS.

Article 9: Authorisation to use participants’ photos and image rights

The Participant expressly authorises the Organising Company to use their image, as captured in their photo, in connection with the Competition for commercial and advertising purposes.

This authorisation applies to any photo or image submitted by the Participant in connection with the Competition.

The Participant hereby transfers their image rights to the Organising Company, subject to the following terms of use:

Droit de représentation: the right to represent, make available, broadcast or communicate to the public the photograph or image of the Participant submitted via a private Instagram message, in whole or in part, to any audience, by any means or methods, present or future, and in particular by means of telecommunications, cable and satellite, over the air, via optical or wired networks, through the Organising Company’s networks

(including internet-based networks and social media platforms such as TikTok, Instagram, Facebook, LinkedIn, YouTube, Snapchat, X), and all computer, electronic communication and audiovisual processes (including digital and/or interactive television and cable broadcasting), whether known or unknown at present.

  • Right of reproduction: the right to reproduce, by any technical means known or unknown to date, all or part of the aforementioned photographs.
  • Right of adaptation: the right to adapt, directly or indirectly, all or part of the aforementioned photographs, in any manner whatsoever and with the assistance of any other service provider chosen by the Organising Company, regardless of the extent and nature of such adaptations (technical, editorial, graphic, etc., and in particular corrections, modifications, simplifications, additions, integrations into existing or future images, transcriptions into a computer system, and the creation of derivative works

This authorisation is granted worldwide, on DUNKIN’ France’s social media platforms, and for an unlimited period. It is granted free of charge. This express consent excludes any subsequent claim for remuneration.

The Organising Company shall exercise all exploitation rights attached to the photograph or image depicting the Participant or to any audiovisual material related to the context specified above. This work shall remain its exclusive property. The Organising Company expressly undertakes not to transfer this authorisation to a third party.

The Organising Company also undertakes not to engage in any unlawful use, or use not provided for above, of the Participant’s photograph or image that is likely to infringe upon their dignity, reputation or privacy, or any other use deemed prejudicial under the French laws and regulations in force.

By entering the Competition, the Participant further undertakes to consent to the use of their photograph and their image rights, which may be requested by the Organising Company where applicable.

What are your rights?

Where it relates to an identified or identifiable person, a person’s image constitutes personal data.

You have the right to request, at any time, the exercise of your individual rights. These rights may be exercised by contacting us via the following channels:

Article 10: Intellectual Property

All trademarks, logos, text, images and other distinctive signs reproduced on materials relating to the Competition are the exclusive property of the Organising Company and are protected as such by the provisions of the Intellectual Property Code.

These Rules do not entail any transfer of rights to these elements to the Participants or the Winner.

Their unauthorised reproduction constitutes an infringement punishable by criminal penalties.

In the event of any contradiction, these Rules shall prevail over all documents (including advertising material) relating to the Competition.

In the event that one or more of the articles of these Rules should become null and void due to a change in legislation, this shall in no way affect the validity and compliance with the other articles of the Rules.

Article 12: Fraud

Any fraud or breach of these Rules may result in the perpetrator’s exclusion from the Competition, with the Organising Company reserving the right, where appropriate, to take legal action against them.

The Organising Company may cancel all or part of the Competition if it appears that fraud has occurred in any form whatsoever, in particular through computerised means, in connection with participation in the Competition or the determination of the Winner.

Article 13: Disputes

These Rules are governed by French law.

In the event of a complaint, for whatever reason, claims must be submitted to DK FRANCE within one (1) month of the closing date of the Competition at the following address: DK FRANCE – 106 Avenue Marx Dormoy 92120 MONTROUGE – France.

Any dispute arising in connection with the implementation of these Rules shall be subject to an attempt at amicable settlement. In the absence of an agreement, the dispute shall be submitted to the competent courts having jurisdiction over the Organising Company’s registered office, unless otherwise required by public policy.
